Nike sues Sega over basketball ad

Nike has a message for video game publisher Sega of America and its recent basketball ads Just don*t do it. The athletic shoes and clothing maker filed suit in federal court on Thursday against Sega and its advertising agency, Leagas Delaney, claiming its television ad featuring a shattering dunk shot was an unfair copy of an earlier Nike campaign starring basketball legend Michael Jordan.

Nike*s suit claims copyright infringement and unfair competition. The Beaverton, Ore.-based company is asking for an injunction barring the ad from further airplay, an order impounding copies of the ad, and either damages for the alleged infringement or a royalty on every copy of the game sold.

"Sega has seen Nike*s press release. However, to our knowledge, we have not yet received an official complaint from the company. Therefore, we cannot discuss this legal issue at this time," a representative for Sega said. A representative for San Francisco-based Leagas Delaney was not immediately available for comment.

So... did they or didn*t they?

ive been looking for this classic over the net for god knows how long - its a 30 sec spot for nike done by wieden+kennedy portland in 1998/9 (actually not sure, maybe 1996?) and directed by jonathan glazer.

the spot features michael jordan going for the winning point wjile the world holds its breath in slo motion.

who can lend this poor creative a lending hand?

I don*t know if Clay has that Nike ad in the archive (it came out in 1996). But Nike did sue Sega becaue the company claimed Sega*s NBA 2K2 spot ripped off Jorden*s frozen moment commercial

How did that lawsuit go? I mean, who won? The homage is really apparant.

thanks for the help.

apropo homages - didnt 118 118 recently suffer the same ailment with their takeoff on honda*s cog? i think they actually got permission from honda.

I think Nike won the lawsuit and then took the settlement money to open new sweatshops in Asia.....I think....(side note just kidding, I love Nike).
