Not really a Fairey fan, but it will be interesting to see how this plays out. Seems to me that the ruling is going to be pretty subjective if the whole thing winds up being about "does it qualify as a new piece of art?".

I dunno, the idea of "taking back the narrative" makes good sense, as does the idea of reassuring PC users that they're doing the right thing by being PC users.
But doing that by directly referencing the Apple ads kind of undercuts it playing that game, it's like Microsoft is acknowledging that Apple has the better idea. I mean, it could still work, based on where the rest of the campaign goes....

Awww, thanks. I been here all along, reading faithfully, and apparently forgetting about that Far Side fly one. I'll keep an eye out, see if I can contribute something more worthwhile than clarifications but, so far away from the big city and the big ad scene…

Yet another rip of an internet funny shot was that one showing a bomb-defuse team playing pranks on each other with air-filled paper bags, I'm sure I saw in an ad later.
That's an old Far Side cartoon; they're building bombs, not defusing them IIRC. But still.

I'm assuming that the lawsuit will be decided on the basis of the Obama image alone unless his history of … umm … "referencing" is allowed.
The artworks discussed in those articles? Looks more like plagiarism to me. The Obama image though, less a direct lift than a lot of his other graphics. It's a great photo, but that visual wasn't really an icon until it was made into the poster unlike those other cases.
