That can not possibly have gone to print. Using internet shots in mockups is one thing, but in the final proof???

PermalinkRegarding using internet-shots as mockups - and then I presume getting another photographer to shoot exactly that - creating an image to look like another (already photographed) image is derivative work no? So either way - using the original internet-image or re-shooting it, they still need to find the author of the first internet-image, which will require serious detective skillz. "Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work. The owner is generally the author or someone who has obtained rights from the author." I am not a lawyer.
(also, I hate having to use pre-existing photographs in mockups. It's my pet peeve as it seems to lock my thinking. Please let me use my damned markers!)
Also, this reminds me a little of that southwest airlines campaign which basically re-shot funny web-viral-filmclips.

PermalinkDon't forget that Miller light "Maxim light" upskirt sniffing dog shot where you even have the original image in the comments. Yet another rip of an internet funny shot was that one showing a bomb-defuse team playing pranks on each other with air-filled paper bags, I'm sure I saw in an ad later.

That's an old Far Side cartoon; they're building bombs, not defusing them IIRC. But still.

PermalinkHi alphasquirrel haven't seen you in ages! Aaaaaah, yes, far side cartoons have their own special place in Badland. They must have spawned one millions ads all on their own. Some Cannes winners even. ;) Cartoons going once, twice.. and oh here's a third time.

PermalinkAwww, thanks. I been here all along, reading faithfully, and apparently forgetting about that Far Side fly one. I'll keep an eye out, see if I can contribute something more worthwhile than clarifications but, so far away from the big city and the big ad scene…
