Can Adidas trademark its stripes?

Adidas has gone to court in order to protect their three-stripe motif. Fitnessworld is accused of riding the coattails of Adidas' popularity by using two stripes. "Adidas argues that Fitnessworld's clothing could confuse the public and says its own brand image risks being damaged since consumers might hold it responsible for the quality of Fitnessworld's clothing."

Too little too late.
You'll find knock-off three striped items amoungst brandware in name-shop all over Europe. Fashion houses have mimicked the stripes. They should have put a stop to it earlier.
"...consumers might hold it (Adidas) responsible for the quality of Fitnessworld's clothing."
Wow. Adidas doesn't give consumers much credit.
